Terms of Service

These terms govern your use of Pogo — the design-for-test analysis tool at pogorobotics.io — operated by Pogo Robotics, Augsburg, Germany ("we", "us"). By using Pogo you agree to them. If you're using Pogo on behalf of a company, you confirm you're authorised to accept these terms for it.

1. What Pogo does

Pogo analyses PCB fabrication files you upload (Gerbers, drill files, placement data) for design-for-test: it reconstructs nets, finds probe-accessible test points, computes coverage and a fixture verdict, and exports a probe plan as CSV. Pogo is advisory — it produces a report and a plan; it never edits your design, and it's no substitute for your own engineering judgement or your fixture house's verification.

2. Accounts

You can analyse boards without an account. Some features (saving projects, exporting the probe plan) require one. Sign-in is passwordless: we email you a magic link, and your email address is your account identifier. Keep access to your email inbox secure — anyone who can read your email can sign in as you. You're responsible for activity under your account.

The free tier currently keeps up to three saved projects; we may change tier limits as the service evolves (see Changes to these terms).

3. Your files stay yours

You keep all rights to the fabrication files and design data you upload. You grant us only the limited right to process and store them to provide the service to you — running the analysis, rendering the board, keeping your saved projects, and generating your exports. We don't use your design data for anything else, and we don't share it with third parties except the infrastructure providers listed in our Privacy Policy.

Only upload files you have the right to use. Don't upload designs you're not authorised to share with a processing service.

4. Acceptable use

Don't:

  • upload malware or content that's unlawful or infringes others' rights,
  • probe, overload, or disrupt the service, or attempt to access other users' data,
  • scrape the service or resell access to it without our written agreement,
  • use automated means to create accounts or circumvent tier limits.

We may suspend or terminate accounts that violate these terms.

5. Availability & beta status

Pilot phase

Pogo is a young product in active development. Analysis results, features, and limits can change, and results may contain errors — always verify the probe plan with your fixture house before committing to tooling.

We provide the service "as available". We don't guarantee uninterrupted availability, and we may modify, limit, or discontinue features (or the service) with reasonable notice where practicable. Keep your own copies of your fabrication files — Pogo is not a backup service.

6. Liability

We're liable without limit for damages caused by intent or gross negligence, for injury to life, body, or health, and under mandatory law (including the German Product Liability Act).

For simple negligence, we're liable only for breach of essential contractual obligations (Kardinalpflichten — obligations whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely), and then only up to the damage that is typical and foreseeable for this kind of service. Any further liability for simple negligence is excluded.

In particular, we're not liable for decisions you make based on analysis results — coverage numbers, fixture verdicts, and probe plans are inputs to your engineering process, not guarantees (see section 5).

7. Changes to these terms

We may update these terms as the product and the law evolve. For material changes we'll give notice with reasonable lead time — by email to account holders and/or a notice in the app — before the new terms take effect. If you keep using Pogo after that date, the updated terms apply. If you don't agree with a change, stop using the service and, if you have an account, you can ask us to delete it at any time.

8. Governing law

These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you're a merchant (Kaufmann), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is Augsburg, Germany. Mandatory consumer-protection rules of your country of residence remain unaffected.

If a provision of these terms is invalid, the rest remains in effect.

EU dispute resolution

The EU platform for online dispute resolution (ODR) has been discontinued as of July 2025. We are not obliged and not willing to participate in dispute-settlement proceedings before a consumer arbitration board (§ 36 VSBG).
